CONFLICT OF INTEREST
CITY COUNCILMAN EMPLOYED AS LEGISLATIVE AIDE
To: (Name withheld at the person's request.)
Prepared by: Phil Claypool
Would a prohibited conflict of interest be created were I, a city councilman, also to be employed as a legislative aide?
Your question is answered in the negative.
In your letter of inquiry you advise that you presently are a member of the City Council of the City of Lauderhill and that you are applying for the position of legislative aide for the Broward County delegation. In CEO 78-97 we found that no prohibited conflict of interest would be created were a city council member to be employed as a legislative aide. See also CEO 77-77.
Accordingly, we find that no prohibited conflict of interest would be created under the Code of Ethics for Public Officers and Employees were you to be employed as a legislative aide. However, please note that, as we cautioned in CEO 78-97, there may be other provisions of law outside the Code of Ethics which you may wish to consider before accepting the position of legislative aide.
